Terms of Service

1. Acceptance
By accessing or using Phase Model ("the Service") at phasemodel.xyz, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Phase Model provides structural macro regime analysis for financial assets including BTC, ETH, SOL, and traditional markets. The Service is offered on a subscription basis with multiple plan tiers.
3. Not Financial Advice
All content and data provided by Phase Model is for informational purposes only and does not constitute financial, investment, legal, or tax advice. Regime signals, charts, and analysis are quantitative models — they reflect historical patterns and statistical tendencies, not guarantees of future performance. You are solely responsible for your own investment decisions. Phase Model assumes no liability for losses arising from actions taken based on information provided by the Service.
4. Accounts
- You must be at least 18 years old to create an account.
- You are responsible for maintaining the confidentiality of your credentials.
- You are responsible for all activity that occurs under your account.
- One account per person. Sharing accounts is prohibited.
- You must provide accurate information during registration. Impersonation or false registration data will result in account termination.
5. Subscriptions and Payments
- Subscriptions are billed on a recurring basis (monthly or annual).
- All fees are charged in USD and are non-refundable unless required by law.
- You may cancel your subscription at any time; access continues until the end of the current billing period.
- We reserve the right to change pricing with 30 days' notice to existing subscribers.
- Payments are processed by Stripe. By subscribing, you also agree to Stripe's Terms of Service.
6. Permitted Use
You may use the Service for personal, non-commercial analysis. You may not:
- Redistribute, resell, or sublicense access to the Service or its data
- Scrape, crawl, or extract data from the Service in bulk
- Use the Service to build a competing product or service
- Reverse-engineer any part of the Service
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
7. API Access
API access is available on eligible plans and is subject to rate limits and usage policies provided in the API documentation. API keys are personal and must not be shared. We reserve the right to revoke API access for misuse or excessive usage.
8. Intellectual Property
All content, models, algorithms, designs, and data produced by Phase Model are the exclusive property of Phase Model. Nothing in these Terms grants you ownership of any intellectual property. You may display and use regime outputs for your personal analysis but may not republish them without attribution and prior written consent.
9. Availability and Changes
We strive for high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time. For significant changes affecting paid subscribers, we will provide reasonable notice.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. Regime signals are statistical models and may be incorrect. We make no guarantee of accuracy, completeness, or timeliness of any data.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Phase Model and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including financial losses, arising from your use of or inability to use the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Termination
We may suspend or terminate your account at any time for violations of these Terms. You may delete your account at any time from your account settings. Upon termination, your right to access the Service ceases immediately.
13. Governing Law
These Terms are governed by the laws of Brazil, without regard to conflict of law principles. Any disputes shall be resolved in the courts of São Paulo, Brazil.
14. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the new Terms. For material changes, we will notify registered users by email at least 14 days in advance.
